not seeing any issues (ping / authoritative dns queries) from my vantage points…
from chicago (equinix, 350 e cermak):
me -> level3 -> HE -> across HE to NYC. traceroutes to ns[1-5] all take the same path.
from los angeles (one wilshire):
ns[1-3]: me -> level3 -> HE ns[4-5]: me -> any2 -> HE
